Terms of Service
These Terms of Service (“Terms”) govern your access to, and use of the SaaS-based CRM platform and related services (“Services”) provided by BizMento (“Company,” “we,” “our,” or “us”). By creating an account or using our Services, you agree to these Terms. If you do not agree, you may not use the Services.
Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Services. By using our Services, you represent that you meet this requirement.
Account Registration
- You must provide accurate, complete, and up-to-date information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity under your account.
Use of Services
- Use the Services only for lawful business purposes.
- Do not misuse, reverse engineer, or disrupt the Services.
- Comply with all applicable laws and regulations.
- We reserve the right to suspend or terminate accounts that violate these Terms.
Customer Data
- You retain ownership of all data you input into the CRM (“Customer Data”).
- You grant us a limited license to process, host, and store Customer Data solely to provide the Services.
- You are responsible for ensuring you have the rights to input Customer Data into the system.
Payment & Subscription
- Services are billed on a subscription basis (monthly or annual, as selected).
- Fees are non-refundable except as required by law.
- We may change pricing upon notice. Continued use after notice means acceptance of new pricing.
- Failure to pay may result in suspension or termination of Services.
Data Security
We implement commercially reasonable security measures to protect Customer Data. However, no system is completely secure, and we cannot guarantee absolute protection.
Intellectual Property
- The Services, software, trademarks, and content remain the property of BizMento.
- You may not copy, modify, or distribute our intellectual property without prior written consent.
Third-Party Services
Our Services may integrate with third-party applications. We are not responsible for the practices or availability of those third-party services.
Termination
- You may cancel your subscription at any time.
- We may suspend or terminate your access if you violate these Terms, fail to pay, or engage in harmful activity.
- Upon termination, your access to Customer Data will end. You may request a copy of your data before deletion.
Disclaimer of Warranties
The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, BizMento is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount paid for Services in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless BizMento, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles.
Changes to Terms
We may update these Terms from time to time. Updates will be posted with an updated “Effective Date.” Continued use of the Services after changes indicates acceptance of the new Terms.
